Divorce Without A Lawyer: The Simpler Way Out



Dealing with a divorce involves a lot of emotional stress, but this is not the only thing that troubles both parties. There are many legal issues to be taken into consideration, like child support, custody, sharing of property and so on. A divorce lawyer is the right person to deal with all these issues, as they know exactly what to do.

Hiring a divorce lawyer can be quite expensive. Sometimes, the two persons that were involved in the marriage are not willing to take on the drag of paying a lawyer and prolong the trouble, as the case can take up to several months. Under such circumstances, they may want to consider solving things between them without a lawyer.

There is a legal solution for those willing to do so. The procedure is called Pro Se divorce, and it involves both parties to be able to file all the necessary papers on their own. Keep in mind that this procedure may be applied only by some and under some very specific circumstances.

Here are the requirements for a Pro Se divorce to be possible. First, both parties must show their agreement about filing for divorce, including on issues like children or property. If there are children involved, they must be of legal age and not included in the divorce. Deposits, pensions or stocks must also not be present. Keep in mind that you cannot ask for alimony if you choose the do it yourself divorce.

The Pro Se divorce does not work unless both parties go for this procedure. People working in the military cannot file such a divorce and a lawyer is imposed in dealing with such cases. If there are episodes of physical or mental abuse of one party on the other, this type of divorce is excluded. Also, things like debts or bankruptcy must not be present, or, otherwise, the Pro Se divorce is not allowed. Another requirement is to demonstrate that both parties will not have any financial problems due to the divorce.

As you may well see, the do it yourself divorce require many aspects to be considered before taking any other step. Still, it is a much more convenient procedure, as a regular divorce requires hiring specialized lawyers, which are far from being cheap. You can save a lot of money, if, along with your ex partner, decide that it is best for both of you to settle things without involving a third party. Of course, some counseling about the papers that need to be filed in order to get access to the Pro Se divorce, may work fine. It can save both of you a lot of trouble, while you can put all the necessary papers together.
