Most people don't realize that they need a lawyer - until they really need a lawyer! At that point, they are rushed, and often panicked, and simply don't have the luxury of shopping around for the best lawyer - they have to take what they can get. This can easily be avoided by knowing in advance which lawyer you would call for different situations, and by establishing a relationship with these professionals in advance as well.

Different lawyers do different things. Some try criminal cases, while others help you with legal matters related to your business. Think about what type of lawyer you may need at some point in advance, and ask friends and relatives for recommendations. You may also consider recommendations of other business owner's.

Some people keep lawyers on a retainer. A retainer can work one of two ways. You can pay your lawyer a monthly fee, and if you need his services, he will be obligated to provide legal services for you. Some people retain a lawyer with one large retainer fee. This works the same way. It is ultimately up to the lawyer as to how he can, or cannot, be retained. Most lawyers from small firms will agree that should a situation come up, that they will represent you. However, you will generally need to pay them something in order for them to be considered 'your lawyer.'

In selecting the lawyer or lawyers that you may wish to use for potential future situations, check references and credentials, including their success ratio. Start your research by checking with the bar association in your state. They will have quite a bit of information about your lawyer. Make an appointment to speak with the lawyer. Let them know that you do not need their services at this point, but that you may need them in the future. Find out what they can do for you, and how much it will cost you.

If you are part of a prepaid legal program, there will be specific lawyers that you can use. Some lawyers will be better than others, and again, you should do your research in advance. Prepaid legal programs work very well, and if you do see a need for a lawyer in your future, such a program may even save you money in the long run.

Aside from prepaid legal programs, you should also consider legal insurance. This works just like health or life insurance does, in that if the need for a lawyer arises, you will be covered - provided legal services - as per the terms of your legal insurance policy. Sometimes this type of insurance is available through employers, but in most cases, it must be acquired privately. Like prepaid legal plans, most legal insurance will require you to use specific lawyers.

The key is to be prepared. Know what lawyer you will use for various legal situations. Establish a relationship with that lawyer. Consider retaining the lawyer, or joining a prepaid legal plan, and look into the possibility of obtaining legal insurance. Then, should a legal situation come up, you will be way ahead of the game.
