The fact is, it is perfectly legal to send cash. The USPS allows it. Not only that, they will insure it for up to $25,000.
If you doubt me, go to the USPS FAQ at http://faq.usps.com/eCustomer/iq/usps and enter "send cash" into the search box. The first search result is "Limit on money (cash) insurable through the mail". Click on that link. Here's what it says.
Limit on money (cash) insurable through the mail.
Money (currency / cash) that is sent through the mail can be insured up to its value, within the stated limits:
For Express Mail® items, the maximum indemnity for currency/cash/money sent through the mail is only $15.
For regular domestic insurance, mail can be insured up to $5,000.
For Registered Mail™ items, the maximum insured value is $25,000
An item worth more than this must still be declared at full value, but the maximum insurable limit is $25,000.
When a claim is filed, money is replaced at the insured value: After evidence of value is shown (if the actual value was less than the insured amount, then only the actual value is paid).
Important: If you are sending a significant amount of cash, you need to verify with your local office what is considered valid evidence of value before mailing the item. You should also verify that it is packaged securely enough to protect a high value item from being harmed during regular mail processing.
Important: Checks are not considered cash, and cannot be insured other than for document reconstruction expense.
So you see, sending cash is obviously NOT against the law.
However, overnight carriers have regulations against sending cash with their service. These are not laws, just company policy. UPS does not allow sending cash internationally. Fedex and DHL will not ship cash at all.
So how do all these cash gifters get away with sending cash via Fedex?
Obviously, they don't tell Fedex that it is cash. They call it documents. They ship it inside a magazine. Most even put it in a stamped and addressed envelope so it is protected from tampering by Federal Law.
The gifting program I belong to allows for gifts other than cash. I will accept cash. But, I encourage those sending a gift to send a money order or certified check.
